Terms of Service

Last updated 15 September 2026

This is the agreement between LoyaltyOS and the businesses that use it. It is written to be read once and understood, so where something is your responsibility rather than ours it says so directly instead of hiding it in a clause.

Who this agreement is between

These terms are between Status X Technologies (“we”, “us”) and the business that opens an account (“you”). By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you are confirming you have the authority to do that.

If you are a shopper who joined a rewards programme, this agreement is not with you. Your rewards are a promise from that shop, on whatever terms the shop set. How your information is handled is covered by the Privacy Policy.

What this is not

LoyaltyOS is not a point-of-sale system.

It does not take your customers’ payments, does not calculate your sales tax, and is not the system of record for your inventory or your books. It records what your till tells it, and turns that into loyalty, gift cards and a picture of your customers. If your point of sale and this disagree, your point of sale is right.

It is also not a payment processor, not a marketing agency, and not a source of legal, tax, accounting or financial advice. Nothing it shows you is advice of that kind.

Your account and your staff

  • You are responsible for everything done through your account, including by staff you invite. Give people the role that matches what they need and remove them when they leave.
  • Keep your credentials to yourself. Tell us promptly if you think an account has been compromised.
  • The information you give us — your business name, address and contact details — must be accurate and kept current. Billing and legal notices go to it.
  • You must be old enough to enter a contract where you live.

Plans, billing and cancellation

Starter$15 a month
1 location · 3 staff accounts · 4 campaigns a month
Growth$49 a month
Up to 3 locations · 10 staff accounts · 20 campaigns a month
Pro$149 a month
Up to 10 locations · 30 staff accounts · 100 campaigns a month
  • New accounts start on a 14-day free trial with no card required. The trial carries the same limits as the Growth plan, so what you evaluate is the product rather than a hobbled version of it.
  • Paid plans are billed monthly in advance through Stripe, and renew automatically until cancelled.
  • Prices are exclusive of any sales or similar taxes, which are added where they apply.
  • You can cancel at any time from Billing. Cancellation takes effect at the end of the period you have already paid for. We do not refund part-months automatically — if something has gone wrong, write to us and we will deal with it like adults.
  • When a subscription ends, the account falls back to the Starter limits rather than switching off. Your data stays; what you can do with it narrows. If you have more locations or staff than Starter allows, existing ones keep working and you cannot add more until you are back within the cap.
  • Failed payments are retried. If payment cannot be collected we may suspend the account after telling you.
  • We may change prices with at least 30 days’ notice, effective at your next renewal. If you do not want the new price, cancel before it takes effect.
  • Enterprise arrangements are invoiced separately and may vary these terms in writing.

Your customers' data is yours

The records of your customers belong to you. You decide what is collected and what is done with it; we hold it and act on your instructions. In the language of privacy law, you are the controller and we are your processor.

That carries obligations, and they are yours:

  • You must have the right to enrol the people you enrol, and to hold what you hold about them.
  • You must give your customers whatever notice the law where you operate requires, and honour their requests to see, correct or delete their record. Ask us and we will help you carry one out.
  • Do not put things in a customer’s notes that you would not defend having written — health information, immigration status, and the like. The field is free text; the judgement is yours.
  • Do not import contacts you bought, scraped, or collected for a different purpose.

We will not use your customers’ data for our own purposes, will not sell it, and will not show it to another business. The separation between businesses is enforced in the database rather than by convention.

Texting and emailing customers

Consent for marketing messages is your responsibility.

Text-message marketing is heavily regulated in the United States — the TCPA, the carriers’ own 10DLC registration rules, and state law on top. Penalties are per message and are not small. The product defaults every marketing channel to off and records an opt-in only when someone gives one, but whether you were entitled to send a particular message is your call and your liability.
  • Send only to people who agreed to hear from you, for the kind of message they agreed to.
  • Honour opt-outs promptly. Every marketing email carries a one-click unsubscribe, and STOP works on any text; do not send around them.
  • Identify yourself as the sender. Your customers agreed to hear from your shop.
  • Messaging depends on the carriers and on our providers. We may pause sending from an account that generates spam complaints or that a carrier blocks, and we will tell you why.

Message and data rates set by the recipient’s carrier are not ours and not yours; they are the recipient’s.

Points, rewards and gift cards

A balance is a promise from your shop, not from us.

Points, rewards and gift card balances are obligations you owe your customers. We record them accurately and keep the ledger honest. We do not hold the money, do not guarantee redemption, and cannot honour a balance if your business stops trading.
  • You set the rules — what earns a point, what a reward costs, whether gift cards expire — and you are responsible for those rules being lawful and for describing them to your customers accurately.
  • Gift card expiry is regulated. Federal law and many states restrict how soon a gift card may expire and what fees may be charged against it, and some prohibit expiry altogether. The software will apply whatever expiry date you set. It does not check whether that date is legal where you trade — you must.
  • Unredeemed balances may be subject to your state’s unclaimed property rules. Those obligations are yours.
  • The ledger is append-only. A mistake is corrected by recording the correction, not by editing history, so a balance can be explained rather than merely asserted.

The AI advisor

On plans that include it, an AI advisor answers questions about your shop using aggregate figures from your own data. What it produces is a suggestion, not advice, and not a prediction. It can be wrong. Check anything you are going to act on, especially before you spend money or change your prices.

Where it reports a pattern, that is a pattern in what happened — not proof that one thing caused another. Decisions you take on the strength of it are yours.

Acceptable use

  • Do not use the service for anything illegal where you operate, or to sell anything you are not licensed to sell.
  • Do not create fake customers, fake visits or fake transactions — including to game a referral scheme.
  • Do not attempt to reach another business’s data, probe the system for weaknesses without asking us first, or work around limits in your plan.
  • Do not resell, sublicense or white-label the service without a written agreement.
  • Do not overload it — scripted or automated use that degrades the service for others is not permitted.

If you find a security problem, tell us at support@loyaltyos.tech before you tell anyone else. We will not pursue anyone who reports a genuine issue in good faith and gives us a chance to fix it.

Availability and support

We work to keep the service running and to fix what breaks quickly. We do not promise a particular uptime percentage unless we have signed a separate agreement saying so — publishing a figure nobody measures would be worth nothing to you.

Maintenance, provider outages and changes to the service happen. Where a change would remove something you rely on, we will give notice rather than let you discover it. Support is by email; we aim to answer within one business day.

Who owns what

  • You keep everything of yours: your business data, your customer records, your name and your logo. You grant us only the permission needed to host and process them so the service can work, and to show your logo where the product displays it to your own customers.
  • We keep the software, the design and the documentation. Using the service does not transfer any of it.
  • If you send us feedback or an idea, we may use it without owing you anything for it. It costs you nothing and it is how the product gets better.

Suspension, cancellation and your data

  • You can cancel at any time, for any reason, from Billing.
  • We may suspend or close an account that breaches these terms, that does not pay, or that we are legally required to stop serving. Except where the breach is serious or urgent, we will tell you first and give you a chance to put it right.
  • After an account closes we keep its data for 30 days and then delete it. We email you seven days before that happens, with a link that holds the deletion if you are not ready. Ask within the window and we will send you a copy of your records; there is no self-service export button yet, so a person does it.
  • The parts of these terms that are meant to outlive the account — payment owed, ownership, liability, and the general clauses below — survive it.

Warranties and liability

The service is provided as it is. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the service will be uninterrupted or error-free.

Neither of us is liable to the other for indirect, incidental, special or consequential losses, or for lost profits, lost revenue or lost data, even if the possibility was known. Our total liability arising out of these terms is limited to the fees you paid us in the twelve months before the claim.

You will cover us against claims that arise from your use of the service in breach of these terms — in particular claims by your own customers about messages you sent them, about a balance you did not honour, or about data you did not have the right to hold.

Nothing here limits liability that cannot be limited by law, including for fraud.

General

  • These terms are governed by the laws of the State of Louisiana, United States, and disputes belong to the courts there.
  • We may update these terms. Material changes get at least 30 days’ notice, and continuing to use the service after they take effect means you accept them. The date at the top always says when the current version began.
  • If any part of this is unenforceable, the rest still stands.
  • You may not transfer this agreement without our consent. We may transfer it in a merger or sale of the business.
  • Neither of us is responsible for a failure caused by something genuinely outside our control.
  • These terms, with the Privacy Policy, are the whole agreement between us and replace anything said beforehand.
